In a recent case that highlights the importance of compliance with regulations, a shop owner and company director faced hefty fines and penalties for possessing and selling illegal vaping products following a thorough investigation by Trading Standards and prosecution by the Royal Borough.
The incident involved the seizure of 52 illegal vaping products from K&B Convenience Store, owned by KK&P Limited, and managed by Mr. Bhaumikbai Patel. Both parties admitted guilt to charges related to product requirements and labelling during a court hearing at Reading Magistrates’ Court.
The illegal vaping products in question failed to meet regulatory standards, containing a higher volume of nicotine liquid than permitted and lacking proper labeling, including a prominently displayed health warning. Despite prior warnings from Trading Standards, the offenses persisted under Mr. Patel's oversight, leading to the charges against him personally and the company he represented.
As a result of the court proceedings, Mr. Patel and KK&P Limited were ordered to pay fines, victim surcharges, and the Royal Borough’s costs amounting to £2,870. Additionally, the illegal vaping products were subject to forfeiture and destruction.
Addressing the issue, Andrew Durrant, Executive Director of Place Services, emphasized the serious implications of selling illegal vaping products. The enforcement actions taken aim to safeguard consumers from non-compliant products and ensure fair competition within the market.
